Judge HU Yunteng Delivered a Lecture on "National Constitution Day" at Tongji University

December 4th, 2020 was the seventh "National Constitution Day" of China. From November 30th to December 6th, it was the third "Constitution Publicity Week". In order to study and publicize President XI Jinping’s thoughts on the rule of law and vigorously promote the spirit of the Constitution, Tongji Law School has invited Judge HU Yunteng, the former deputy ministerial member of the Judicial Committee of the Supreme People’s Court and a second-level judge, to be a guest at Tongji to deliver a lecture on "Preventing Unjust, False and Wrong Cases Through Fair Trial". This lecture was hosted by Prof.JIANG Huiling, Dean of Tongji Law School. Nearly 600 teachers and students have attended this report online.

   


 


Unjust, false and wrongly cases are a far-reaching and global problem. Judge HU explained the types of these cases, the basic situation of the people's courts in correcting them, their possible reasons, and ways on how to prevent and correct them.

     

He pointed out that the objective reasons are the omissions in the judicial system, mechanisms and procedures, as well as the insufficient conditions for handling cases. Meanwhile, subjective reasons are deficiencies of case handling capabilities and methods of those judicial personnel.

It is of significance to strengthen the defense against unjust, false and wrong cases fundamentally, and attach importance to the use of science and technology to prevent them. 

     

Finally, Prof.JIANG Huiling summarized the lecture. He believes that unjust, false and wrongly cases are a serious legal topic and a severe social problem. He has shared three opinions of his own by setting a lively metaphor. Firstly, unjust, false and wrongly cases are like cancerous diseases in a civilized society. Although the dysfunctional area is small, it is very toxic. Secondly, these cases must be prevented and avoided by the immunity of the civilized society as a whole. Last but not the least, it requires to rely on the construction of a team of legal professionals with strong political and high quality.

 

During the lecture, students from different schools have actively asked questions on this topic and other relevant criminal legal issues. Judge HU Yunteng has also given detailed response to these questions one by one.
