Insight | Dean Huiling JIANG Addresses on How Should the CPC Support Justice

On December 4, 2022, Tongji University held the inauguration ceremony of Inner-Party Regulations Research Center and the academic symposium on “The Construction of Inner-Party Regulations System in the New Era”. Prof. Huiling JIANG, Dean of Tongji Law School, was invited to attend the conference and delivered a keynote speech entitled “On the connotation and realization path of supporting justice in the context of governing according to the law".

In his keynote speech, Prof. Huiling JIANG pointed out that in the process of governing according to the law and the Constitution, the CPC has gradually formed a mature relationship between the Party and the rule of law, which is expressed as “leading legislation, ensuring law enforcement, supporting justice, and taking the lead in abiding by the law”. This is an accurate positioning of the “party-law” relationship, and an important experience in the construction of the party and the progress of the rule of law. It should be said that as far as the three core functions of the state are concerned: legislation, law enforcement and justice, the Communist Party has to play the role of leadership, guarantee and support, but taking into account the unique operation rules of these three functions, the Central Committee has put “leadership”, “guarantee” and “support” correspond to “legislation”, “law enforcement”, and “justice” respectively. In other words, the CPC decides the most suitable expression of the “Party-Law” relationship in the three rule of law scenarios according to the unique attributes of the three rule of law activities, fully reflecting the relevance and precision of the Party’s leadership, rather than just covering the three legal functions with very different attributes in a general and generic way of leadership. It should be said that leading legislation, ensuring law enforcement and supporting justice are the most appropriate and matching expressions of the “party-law” relationship.

At the seminar, the leaders of Tongji University and Shanghai Municipal Education Commission jointly inaugurated the Tongji University Inner-Party Regulations Research Center. The Center will become an important platform for Tongji University to coordinate the efforts of all parties to study Inner-Party regulations and build a socialist rule of legal system.
