On June 21, the lecture "The Relationship between Labor Law and Civil Law in the Context of the Civil Code" was held in Room 1305, Zhonghe Building, Tongji University. This lecture was hosted by Prof.WANG Qian, associate professor of Tongji Law School. The speaker was Prof.WANG Quanxing, professor from Shanghai University of Finance and Economics School of Law and vice president of the Chinese Society of Social Law.
Prof.WANG Quanxing discussed the division of labor between civil law and labor law in the context of the new era based on the historical changes of more than 40 years of reform to protect workers.
At the end of the lecture, Mr.ZhANG, a lawyer graduated from Tongji Law School, asked Prof.WANG whether the labor relationship in the takeaway platform should be protected by labor law and related legislations. In this regard, Prof.WANG believes that the relationship in the platform is a labor exchange relationship, and takeaway riders are at a disadvantage. Currently, takeaway riders are under a subordinated relationship with their employers, and the platform has the obligation to protect its riders. Both the theoretical and practical circles have reached consensus on these issues, but there has not been a consensus on the specific protection rules and arrangements. There should be special legislation in the future.
